1. Overview

This Privacy Policy explains what personal data Visagely collects, why we process it, how long we keep it, and the rights available to you. We process personal data in line with the EU General Data Protection Regulation (GDPR) and similar laws where applicable.

2. Data we collect

• Account data: email address, password hash, optional two-factor settings, and account preferences.
• Photos & model data: images you upload, derived face/body analysis needed for quality checks, and any personal model or training artifacts created for your account.
• Generated content: images created for you and associated generation metadata (scene, settings, timestamps).
• Billing data: token purchases, transaction references, and limited payment status information from our payment provider. We do not store full card numbers on Visagely servers.
• Support data: messages, ticket numbers, and related correspondence.
• Technical data: IP address, device/browser type, approximate location derived from IP, cookies or similar identifiers, and security logs.

3. Why we process data

• Contract: create and manage your account, process token purchases, deliver generations, and provide support.
• Legitimate interests: secure the Service, prevent abuse and fraud, improve model quality and product experience, and understand aggregate usage.
• Consent: optional marketing emails and non-essential cookies, where required.
• Legal obligation: tax, accounting, and compliance with lawful requests.

4. Photos and biometric-like processing

Uploaded portraits may be analyzed for face presence, pose, quality, and similar signals so we can warn you about unsuitable training images and produce better results. This processing is performed to provide the Service you request. We do not sell face data. We do not use your photos to train public foundation models for unrelated customers without a separate lawful basis and notice.

5. Sharing

We share personal data only with:

• Infrastructure and AI processing providers that host or run the Service under contract.
• Payment processors for checkout and fraud prevention.
• Email and support tooling needed to communicate with you.
• Professional advisors or authorities when required by law or to protect rights and safety.

We do not sell your personal data. If we transfer data outside the EEA, we use appropriate safeguards such as Standard Contractual Clauses where required.

6. Retention

We keep account and billing records for as long as your account is active and for a limited period afterward as needed for disputes, security, and legal retention. Uploaded training photos and personal model files can be deleted when you delete your account or specifically request deletion, subject to short backup windows. Support tickets may be retained to maintain a service history.

7. Your rights

Depending on your location, you may have the right to:

• Access the personal data we hold about you
• Correct inaccurate data
• Delete data or request account erasure
• Restrict or object to certain processing
• Receive a portable copy of data you provided
• Withdraw consent where processing is consent-based
• Lodge a complaint with a supervisory authority

You can manage many preferences in Settings, or contact us via Support. We may need to verify your identity before fulfilling a request.

8. Security

We use technical and organizational measures appropriate to the sensitivity of portrait data, including encrypted transport, access controls, and session protections. No method of transmission or storage is perfectly secure; please use a strong unique password and enable two-factor authentication when available.

9. Children

Visagely is not directed to children and we do not knowingly collect data from anyone under 18. If you believe a minor has used the Service, contact Support and we will take appropriate steps to delete the account and related data.

10. Changes

We may update this Privacy Policy from time to time. The “Last updated” date at the top of this page will change when we do. Significant changes will be highlighted in the product or by email when appropriate.
