1. Agreement

These Terms of Service (“Terms”) govern your access to and use of Visagely’s websites, applications, and related services (collectively, the “Service”). By creating an account, purchasing tokens, uploading photos, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use Visagely.

2. Who we are

Visagely provides AI-assisted tools that help adults create realistic portrait and lifestyle photos for personal dating-profile use. References to “Visagely,” “we,” “us,” or “our” mean the operator of the Service. Contact details for legal and support inquiries are available on the Support page.

3. Eligibility

You may use Visagely only if all of the following are true:

• You are at least 18 years old (or the age of majority where you live).
• You have the legal capacity to enter into a binding agreement.
• You are not barred from using AI image services under applicable law.
• You will only upload photos of yourself, or photos you have clear rights and permission to use.

We may request age assurance or identity checks and may suspend accounts that fail those checks or appear to involve minors.

4. Accounts

You are responsible for your account credentials, for activity under your account, and for keeping your contact email accurate. Notify us promptly if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms, appear fraudulent, or create risk for other users or Visagely.

5. The Service

Visagely lets you upload selfies or portrait photos, train or configure a personal model where available, and generate new images using tokens or other credits. Features may change, be limited by region, or require a minimum token balance. We do not guarantee uninterrupted availability, specific likeness quality, platform approval on third-party dating apps, or any particular dating outcome.

6. Your content and license

You retain ownership of photos and other materials you upload (“User Content”). You grant Visagely a worldwide, non-exclusive, royalty-free license to host, process, reproduce, adapt, and display User Content solely as needed to operate, secure, improve, and provide the Service to you - including running AI models, quality checks, abuse prevention, and customer support.

You represent and warrant that:

• You own or control the rights needed to upload and process the User Content.
• User Content does not depict minors in any sexualized or exploitative context.
• User Content does not infringe privacy, publicity, intellectual property, or other rights of any person.
• You will not upload illegal, hateful, or non-consensual intimate imagery.

7. Generated images

Subject to these Terms and applicable law, you may use images generated for your account for personal, non-commercial dating-profile and personal branding purposes. You may not use outputs to impersonate another real person, to create deepfakes of anyone other than yourself, to defraud others, or to violate platform rules of dating apps or social networks. Visagely does not claim copyright ownership over your personal generated portraits, but we may retain technical copies as needed for delivery, safety, and service integrity.

8. Acceptable use

You agree not to:

• Reverse engineer, scrape, or overload the Service.
• Circumvent security, billing, token, or usage limits.
• Upload malware or attempt unauthorized access.
• Use the Service for commercial stock, advertising resale, or adult content markets without our prior written consent.
• Harass, threaten, or harm others through the Service.
• Misrepresent AI-generated images as unedited photographs where disclosure is required by law or platform policy.

9. Third-party services

The Service may rely on hosting, email, payments, analytics, captcha, or AI infrastructure providers. Dating apps and social platforms are independent third parties; their rules apply separately and Visagely is not responsible for their actions or decisions.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI OUTPUTS MAY CONTAIN ARTIFACTS, INACCURACIES, OR UNEXPECTED RESULTS.

11. Limitation of liability

To the fullest extent permitted by law, Visagely and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or reputational harm. Our aggregate liability arising out of the Service will not exceed the greater of (a) the amounts you paid to Visagely for tokens in the three months before the claim or (b) €50.

12. Indemnity

You will indemnify and hold Visagely harmless from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your use of generated images, or your breach of these Terms.

13. Changes and termination

We may update these Terms by posting a revised version with a new “Last updated” date. Material changes may also be communicated by email or in-product notice where practical. Continued use after changes become effective constitutes acceptance. You may stop using the Service and request account deletion at any time through Settings or Support.

14. Governing law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law rules, unless mandatory consumer protections in your country of residence require otherwise. Courts in Amsterdam shall have exclusive jurisdiction, subject to any non-waivable consumer rights.
